User Generated Content

You hereby grant us the worldwide, non-exclusive, perpetual, irrevocable, royalty-free right and license to publish, display, reproduce, modify, create derivative works of and commercially exploit any material, information, notifications, reviews, articles, photographs, art, logos or other types of communication (hereinafter referred to as the "User-Generated Content" or "UGC") which you create on the Site as a registered user of the Services (“Registered User”). We may freely use and transfer the UGC and disclose the UGC to third parties. By creating or posting any UGC on the Site, you expressly represent and warrant that you have the right to grant us the foregoing license and that such UGC does not infringe or violate the rights of any third party.

If you choose to submit user generated content to any public area of the Services, this content will be public and accessible by anyone. We do not control who will have access to the information that you choose to make available to others, and cannot ensure that parties who have access to such information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available, or for the accuracy, use or misuse of any information that you disclose or receive from third parties. Registered Users are liable for the UGC they publish on the Site.

Registered Users must not, and must not allow any third party to, publish UGC on the Site which:

  • is of a marketing nature or has marketing purposes,
  • is unlawful, deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, defamatory, tortious, obscene, pornographic or profane, has sexist, political or racial character, violates other people's rights, including any intellectual property rights, rights of privacy and/or rights of publicity,
  • is offensive or in any way breaches any applicable local, national or international law or regulation,
  • violates this Privacy Policy, reveals any personal information about another individual, including another person's name, address, phone number, email address, credit card information or any other information that could be used to track, contact or impersonate that person,
  • has a disloyal or unlawful purpose and/or content (or promotes unlawful purposes), or
  • is technically harmful (including without limitation computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software, harmful data or conduct).

Third Party Websites and Links

Our Site may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated with or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Children’s Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

Do-Not-Sell or Share My Personal Information

You acknowledge that we do not currently respond to web browser “do not track” signals or other mechanisms that indicate your preference for not having information collected over time and across different Websites or digital apps following your visit to one of our Site.

Finally, we do not “sell” or “share” California Personal Information about consumers that we know are younger than 16 years old without opt-in consent.

If you are a California resident and wish to request the exercise of these rights as detailed above or have questions regarding the California Personal Information collected or shared with third parties, please contact us at info@goodtimebrewing.com.  When submitting your request, please include the specific nature of your request, referencing "Your California Privacy Rights," as well as your first and last name, email address, and zip code or mailing address.  We may apply any exceptions or other conditions available under law when responding to access, correction, deletion, or other requests. We will generally fulfill requests for access, correction, and deletion within 45 days of receiving a valid verified request. We may extend the respond time by another 45 days by notifying the individual of the time extension. 

 

Authorized Agents


To the extent that you elect to designate an authorized agent to make a request on your behalf, the authorized agent must provide appropriate documentation including written signed permission from you, proof of your identity, and verification of the agent’s identity; a valid, designated power of attorney as defined under the California Probate Code, and certificate of registration as an agent before the California Secretary of State.  If you are an agent submitting the request on behalf of a California consumer, please contact us at info@goodtimebrewing.com.

 

Financial Incentives 


We may offer rewards programs that allow participants to earn or otherwise receive discounts in return for registering and/or making purchases or leaving a review. Participation in these programs is voluntary and requires your prior opt-in consent, which you may revoke at any time by following the instructions provided in such terms. Information collected via these programs may include email address and other contact information, demographic information, and opinions. 

 

Because our programs involve the collection of personal information, they might be interpreted as a “financial incentive” under California law. The value of your personal information to us is related to the value of the perks (e.g., discounts) provided in the program less the expense related to offering those benefits to program participants. 

 

Data Retention


We keep your California Personal Information for as long as needed or permitted according to the purpose(s) for which it was obtained. The criteria used to determine our retention periods include (i) for as long as we have an ongoing relationship with you; (ii) for the duration of a contract with you; (iii) as required by a legal obligation to which we are subject to; or (iv) as advisable considering our legal position (such as in regard of applicable statutes of limitations, litigation, or regulatory investigations).   We may remove California Personal Information for inactive accounts from our database, subject to any applicable legal or regulatory obligations. Shine The Light 


Separately, under California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), California residents who provide us their Personal Information are entitled to request and obtain from us, free of charge, information about the Personal Information (if any) we have shared with third parties for their own direct marketing use; such requests may be made once per calendar year for information about any relevant sharing in the prior calendar year (so, requests submitted in 2024 would be applicable to relevant disclosures (if any) in 2023). In your request, please attest to the fact that you are a California resident and provide a current California address. We will reply to valid requests by sending a response to the email address from which you submitted your request.
